摘 要 自上个世纪80年代，民事“执行难” 问题便困扰我国人民法院。近几十年来，虽然我国司法改革 的步伐从未停止，但就最高人民法院每年公布执结数据来看，收到的成效甚微，人民群众的反映仍 是不中意，本文就基于此出发，探讨民事“执行难”的成因与对策等问题。 本文分绪论、民事执行难概述、民事执行难原因分析与解决民事执行难的对策四章。 本文的第一章绪论，笔者对国内外民事执行研究的现状简洁的做了评述； 本文的第二章，笔者首先提出了对民事执行难的理性界定方式，接下来，笔者归纳总结了21世 纪新形势下，民事执行难的表现形式； 本文的第三章，笔者从立法、司法、执行环境三个方面剖析了造成民事执行难的原因，其中执 法环境的原因包括地方爱护主义与社会诚信意识缺失两部分内容； 本文的第四章，笔者有针对性地提出了解决民事执行难的对策，即尽快出台强制执行法、改革 执行体制与改善执法环境。 关键词：执行难 ；表现；原因；对策 The Study On the Difficulty of Civil Execution in Our Country Abstract Since the 1980s, the Difficulty of Civil Execution problem plagued our peoples court. In recent decades, although the pace of judicial reform in China has never stopped, the situation receive little success and the people is still not satisfied from annual data on the implementation of view published by the Supreme Peoples Court. Based on the situation, the article is to explore the causes , countermeasures and other issues in civil difficult implementation. This article is divided into four parts: introduction, the difficulty of civil execution, the difficult analysis of civil execution and the countermeasures to solve the difficult implementation of civil affairs. In the first chapter, the author briefly reviews the current situation of civil execution research both at home and abroad. In the second chapter, the author first puts forward the rational way to define the civil implementation difficult, then sums up the new situation in the 21st century, the implementation of civil difficult form.
