论网约车的地方立法规制
摘要
网约车自2014年进入市场,经历几年的进展渐渐步入正轨。2016年,交通部等七部委联合颁布
部门规章《网络预约出租汽车经营服务治 暂行方法》,承认了网约车的合法地位。之后,各地为了
响应中央号召,依照《立法法》《行政许可法》以及《网络预约出租汽车经营治 暂行方法》等制定出
相关的地方网约车实施细则。然而,地方网约车立法中存在诸多法律问题,如宪法、行政法和程序
法问题。为规制网约车地方立法,笔者通过列 地方立法中存在的法律问题,借鉴其他地区的有益
实践,提出坚持“市场有限”与“服务型规制”理念的结合、加强网约车地方立法的立法控制,创新与
完善网约车监管体制的解决对策,探讨网约车地方立法的正确走向,以期完善网约车类法律体系。

Research on the local legislation regulation of the online-taxi booking
Abstract
The online taxi has entered the market since 2014 and has slowly entered the right track after
several years of development. In 2016, the Ministry of Transportation and other seven ministries and
commissions promulgated the ‘Interim Measures for the Administration of Online Taxi Reserving
Business Operations and Services’, which confirmed the legal status of Internet booking taxi in the form
of departmental regulations. Subsequently, in response to the Central Governments calling, various
localities have formulated relevant local regulations on the implementation of the network booking taxi in
accordance with the ‘Legislative Law’, the ‘Administrative License Law’ and the ‘Interim Measures for
the Management and Administration of Internet Booking Taxi’. However, there are many legal problems
such as Constitution, administrative law and procedural law in the local legislation of the Internet. In
order to regulate the local legislation, author lists the legal problems existing in the local legislation and
draws on the beneficial practices of other regions. This paper puts forward measures to adhere to the
