? ? 对民办教育营利与非营利性的思考 ? ? 摘要：民办 教育 能否营利的 问题 是民办教育实践及其立法规范中的争论焦点。本文从“非营利性”的一般概念出发，借鉴国外非营利组织及民办学校的经验，结合我国 社会 经济 和民办教育的 发展 背景，对民办教育的营利与非营利性问题作出 分析 。本文认为，从 理论 和各国经验看，民办教育应存在营利性与非营利性两种不同的形式，在我国 目前 投资激励为主的情况下更应有营利性民办学校的存在；同时，为与教育法协调，文章也提出一些现实性政策建议。 关键词：民办教育，非营利性，中华人民共和国民办教育促进法 ?
