论学校体育伤害事故中校方承担的法律责任

摘要：面对国际体育发展新形势、新机遇，体育强国战略被赋予了新时代意义。开齐开足体育课被更广泛的在学校推广展开，但是伴随着学校体育伤害事故屡屡发生，如何界定校方法律责任往往成为社会关注的焦点，值得引发对于我国学校法律责任认定建设的一点思考。其中面对2019年国务院出台的《体育强国建设纲要》，更是通过国家层面给予了社会及学校关于体育建设行动引导，明晰国家、社会、学校、个人在学校体育事故中法律关系变得极其重要。本文通过广泛搜集并大量整理了有关数据和案例分析，运用文献查阅等方法，有针对性地深入研究学校体育伤害事故中承担法律责任，分别描述现实中此类法律界定中存在的问题，深入挖掘进一步完善的对策措施，以便我国未来学校体育活动建设的合理化、合法化。

Abstract：Inthefaceofthenewsituationandopportunitiesofinternationalsportsdevelopment,thestrategyofsportspowerisendowedwithnewerasignificance.Kaiqikaifuphysicaleducationismorewidelypromotedinschools,butwiththefrequentoccurrenceofschoolsportsinjuryaccidents,howtodefinetheschoolslegalresponsibilityoftenbecomesthefocusofsocialattention,whichisworththinkingabouttheschoolslegalresponsibilityidentificationconstruction.Amongthem,theoutlinefortheconstructionofasportspowerissuedbythestatecouncilin2019givesguidancetothesocietyandschoolsonsportsconstructionactionsatthenationallevel,anditbecomesextremelyimportanttoclarifythelegalrelationshipbetweenthestate,society,schoolsandindividualsinsportsaccidentsinschools.Inthispaper,throughcollectingandorganizingtherelevantdataandcaseanalysis,usingthemethodofliteraturereview,atargetedresearchbearlegalresponsibilityintheschoolsportsinjuryaccident,describerealitysuchproblemsexistinginthelegaldefinition,digfurtherperfectcountermeasuresandmeasures,sothattherationalizationoftheconstructionoftheschoolsportsactivitiesinourcountryinthefuture,andlegalization.
