ABSTRACT

TheconceptofsexualharassmentwasfirstintroducedtoChinainthe

1980s,butthisdoesnotmeanthatthephenomenonofsexualharassment

onlyemergedatthistime.Sexualharassmentisprevalentinvariouscountries

andhasgraduallyevolvedintoaglobalpublichealthissue.Inresponsetothe

needsofsocialreality,protectingthelegitimaterightsandinterestsofworkers,

andcreatingagoodworkingenvironment,theWomensRightsProtectionLaw

(2005Amendment)andtheSpecialProvisionsontheLaborProtectionof

FemaleWorkershavemadevaryingdegreesofregulationsonsexual

harassment,butthesecannotmeettheneedsofsolvingincreasinglycomplex

practicalproblems.

TheCivilCodepromulgatedin2020usheredinaneweraofsexual

harassmentnorms.Article1010ofthelawestablishesindividualresponsibility

forsexualharassment,clarifiesthelegalobligationofunitstopreventand

controlsexualharassmentintheworkplace,andrefinesthecontentofthe

obligation.Inaddition,itisworthnotingthatArticle1010oftheCivilCodealso

degenderedsexualharassment,meaningthatsexualharassmentisno

longersolelytargetedatwomen,andmenmayalsosufferfromsexual

harassment.However,withtheemergenceofArticle1010oftheCivilCode,

therearealsomanyurgentproblemsthatneedtobesolved.Thisarticledoes

notdefineworkplacesexualharassmentbehavior,andthespecificprevention

andcontrolobligationsthatunitsneedtofulfillinworkplacesexualharassment

arenotveryclear.Inaddition,thefollow-upresponsibilitiesthatunitsshould

bearforviolatingworkplacesexualharassmentpreventionandcontrol

obligationsarenotclear,namelywhethertheunitbearsresponsibility,what

kindofresponsibilitytheunitbears,thenatureofunitresponsibility,andthe
