（ 二○一一届） 毕业论文（设计） 题　　目：　 论我国行政听证的适用范围 　 学　　院：　　　 　　　　　　 专　　业：　　　 法学 　　　　　 班　　级：　　　 　　　 学　　号：　　　 　 姓　　名：　　　 　　　　 指导教师：　　　 　　　　 　 教　务　处　制 2011年5月12日 论我国行政听证的适用范围 [摘要]听证制度已经成为各国行政程序法的核心，是限制日益扩张的行政权和保障相对人合法权利的一项重要的制度。而听证的适用范围又是听证制度中的关键，因为听证的适用范围决定着公民参与行政管理的广度和深度。由于我国引入听证制度的时间尚短，与国外相比，还有很多问题急需完善。目前我国听证涉及的领域主要在行政处罚、价格决策、行政立法和行政许可领域，而行政管理的其他更广泛的领域还未确立听证制度，且在已确立听证程序的领域中，其范围也是有限的，这远不能满足法制发展的需要。本文将通过对比西方国家先进经验，提出几点完善我国行政听证制度适用范围的建议。 [关键词]行政听证；适用范围；确立方式；确立原则 [Abstract]The hearing system has become the core of administrative procedure law all over the countries, it is an important system to restrict the expanding executive power and to protect the legal rights of relative person. And the applicable scope of the hearing is the key point of the hearing system, because the applicable scope of the hearing determines the breadth and depth of administrative management that citizen participate in. It is a short time for our country to introduce the hearing system, so compared with the foreign countries, there still has a lot of problems need to be solved. At present, the main areas of our country’s hearing involved in administrative punishment, price decision-making, the administrative legislation and the administrative licensing, but there are more wildly fields of the administrative management haven’t established the hearing system, and the scope of the established is limited, which cannot satisfy the needs of the development of legal system. This article will put forward several suggestions through comparing the western countries’ advanced experience to perfect the scope of application of hearing system.
