摘 要 《劳动合同法》自颁布实施以来争议不断，国际金融危机的到来，使它再度成为热议 的焦点。许多人甚至将企业倒闭的责任归咎于刚刚实施一年的《劳动合同法》。本文用事 实说话，证明了《劳动合同法》并非企业发展的阻碍因素，为贯彻实施《劳动合同法》提 供了实证依据。 本文作者通过深入河源市各基层企业，在收集数据、听取各方意见的基础上，运用统 计学的理论和方法，对河源市企业实施《劳动合同法》前后的变化进行对比分析，揭示了 该法对企业影响的真实情况，得出结论为《劳动合同法》的实施对河源市企业的经营、成 本和用工状况等方面产生的负面影响不大。本文再从宏观的角度，利用 20 年来河源市地 区生产总值数据，建立模型预测未来河源市经济发展的趋势，并且得出分析结论为由于政 府引导到位，企业积极应对，河源市在金融危机条件下，经济发展仍然呈现出一派喜人的 景象。最后，本文结合河源市实际和当前国际金融危机的形势，创新性地提出了政府应帮 扶引导、企业要改变经营模式和员工应增强法律意识等相关的应对措施，希望能给各级政 府制订劳动关系政策提供一定的参考依据，同时也希望能为政府、企业和员工共度国际金 融危机难关提供一定的帮助。 关键词：劳动合同法；河源；企业；影响 I Abstract There has been much controversy over the Labor Contract Law since its implementation and even so with the coming of the global financial crisis. Many ascribed the bankruptcy of the enterprises to the Law which was put into force just a year ago. Based on the fact, this paper proves that the Law constitutes no impediment to the development of the enterprises and thus providing the empirical evidence for its implementation. The author carried out a thorough and meticulous research into the grassroots enterprises in Heyuan city, collected data and listened to different points of view. Using the statistics theory and method, the author makes a comparison analysis of the enterprises’ changes prior to and after the Law’s implementation, and reveals the Law’s real effect on the enterprises. It is concluded that its implementation does not have negative effect on such issues as the Heyuan enterprises’ management, cost and employment. From a macroscopic perspective, this paper builds a model to forecast Heyuan’s economic development trend utilizing its GDP in the past 20 years. Furthermore, it comes to the conclusion
