内容提要 国际民商事诉讼法是国际私法的主要组成部分，它和冲突法、统一实体法相辅 相成，共同保证国际民商事交往的顺利、有序进行。鉴于司法主权原则在这一法律 领域的重要性，本文选取了西欧国家荷兰作为研究对象，试图揭示荷兰法院审理国 际民商事案件的诉讼程序的全貌，并对此进行分析考察。 全文共分四章: 第一章从国际民商事诉讼程序启动后的首要问题— 管辖权入手，在扼要介绍 荷兰法院的组织结构和司法的指导原则的基础上，分析了荷兰国际民商事管辖权的 确定方法与主要规则。 第二章阐述了荷兰法院审理民商事案件的基本的诉讼程序，包括普通程序、简 易程序、基本诉讼程序的相关制度和上诉程序。 第二章在上一章的基础上，探讨了国际民商事TiF讼中的一些特殊问题，包括有 关特殊债权的诉讼程序，域外送达和取证，并重点分析了非方便法院原则在荷兰颇 具特色的适用方法。 第四章谈到了国际民商事诉讼程序的最后、也是最关键的一环— 判决的承认 与执行，着重论述了荷兰法院对外国判决与裁决的态度和实践 关键词:荷兰 国际民商事诉讼 管辖权 判诀的承头与执行 ABSTRACT Internationalcivilandcommercialprocedurelaw,anessentialpartofthe privateinternationallaw,cooperatingwith conflictrulesanduniform substantivelaw,makesagreatcontributiontothesmooth,orderlydevelopment ofaworldwidecivilandcommercialrelationship.Consideringtheimportant functionofjudicialsovereigntyinthislegalsphere,asurveyoftheinternational civilandcommercialprocedurelawinNetherlandsisthesubjectofthis dissertation,whichisdividedintofourparts. PartOneintroducesthestructureofDutchcourtsandguidingprinciplesin theadministrationofjustice.Thereafter,fourindispensableelementsleadingto thedeterminationofDutchcourtsjurisdictionofcivilandcomm ercialmatters areanalyzed. InPartTwo,thebasicactions,includingsummaryproceedings,appealsand germaneproceduralstipulations,whichgoverntheactsofDutchcourtsand litigants,arefullypresentedanddiscussed. Basedontheabovecontents,PartThreefocusesonsomespecialissues relatingtotheinternationalcivilandcommercialproceedings,suchasservice abroad.Moreattentionispaidonthedistinctapplicationofforum non- conveniensinNetherlands. PartFourdealswiththelast,yetthemostcrucialstageintheinternational civilandcommerciallitigation- recognitionandenforcementofdomestic andforeignjudgmentsandordersinNetherlands.Arbitrationawardsare touchedupontoo.
