摘  要  版权制度一直随着传播技术和传播方式的进步而发展，数字技术与网络环境 给知识传播带来了深刻的变革，信息网络传播权正是法律为了适应网络时代的要 求而赋予权利人的一项新权利。然而权利人难以有效行使信息网络传播权，个人 无法对其作品在网络上的使用进行有效控制。相对于信息网络传播权个人管理的 不足而言，信息网络传播权的集体管理凭借其种种管理上的优势，正是实现信息 网络权利人合法权利的有效手段。比如：信息网络传播权集体管理可以降低版权 交易成本；解决作品分散性问题；有利于处理网络版权使用纠纷；有效维护网络 环境下的版权平衡等等。 作品网络传播相对于传统传播有其特殊性：即传播的实时性、交互性、广播 性、复制的无限性与完整性。由此可以将信息网络传播权的特征归纳为：法律确 认性、主体专有性、权利限制性、权利特定性、权利复合性、权利公开性和权利 交互性等七大特征。 信息网络传播权对集体管理提出了新的要求。信息网络传播权集体管理的特 殊要求主要来自新的权利主体、客体、内容及新的权利四个方面。 信息网络传播权集体管理的特殊性要求传统版权集体管理组织向信息网络 传播权集体管理组织的转变应经过三个发展阶段：一是各类集体管理组织之间的 合作，如连接彼此的数据库，并逐步统一和协调其职能；二是由信息网络传播权 集体管理组织集中管理作品网络传播并建立更为集中的版权网络管理中心；三是 在严格、高效、统一的集中管理基础上，依据合同进行个人管理。 国外的做法是在整合传统集体管理资源的基础上对信息网络传播权进行集 体管理，在网络技术方面，均构建了著作权网络管理系统。综合各国经验，信息 网络传播权集体管理主要表现为四种模式：（1）民间网站版权集体管理模式； （2）著作权集体管理组织的单一性或综合性模式；（3）协调版权集体管理组织 模式；（4）新建网络传播权集体管理组织模式。结合我国的实际情况，我国应 该在传统集体管理的基础上新建信息网络传播权集体管理组织。 信息网络传播权集体管理应该在网络技术方面得到保证，因此必须充分利用 网络技术构建一个完整的信息网络传播权网络管理系统。此系统主要有如下作 用：（1）版权管理系统可以实现作品的自愿登记；（2）作品版权信息查询；（3） 作品授权使用情况；（4）在线许可；（5）在线征收；（6）在线分配版税；（7） 在线监管。此外对系统在方便性、稳定性和安全性方面应有较高要求。 关键词：著作权；互联网；信息网络传播权；著作权集体管理 I ABSTRACT With the development of propagating technologies and modes, the copyright system has been progressing. Digital technologies and internet have an impact on propagating of knowledge. The propagating right of the information network is a new kind of right endowed to the right owner by the law to meet the demand of the era of the network. However, individuals can not control copyright well when their works are propagated on internet. Analyzed from angles of economy, management, technique, and international communication, the collective management of propagating right of the information network system is superior to individual management. She can reduce the cost of dealing of copyright, solve the problem of distribution of works, help to cope with the tangles of use of network copyright and maintain the balance of copyright under the network environment.
