论刑事诉讼中免证特权制度-毕业论文.doc

摘  要  刑事诉讼中的免证特权制度是刑事证据制度的重要组成部分。免证特权制度 设立的目的是为了保护人类亲情关系和特殊的职业信赖关系。我国古代就有与此 相类似的亲属间的“容隐制度”，并一直延续到民国时期，但我国目前的刑事诉 讼立法中并没有建立免证特权制度。在国外，基于获得更高层次的社会利益和保 障刑事诉讼中公民权利的需要，免证特权制度规定的非常详细和具体，适用的范 围也很广泛，可以为我国未来的立法所借鉴。 论文共分为四个部分。第一部分介绍了免证特权的概念及其理论基础的发 展，并对容易与其相混淆的概念作了详细比较。第二部分主要介绍国外的免证特 权制度，并加以评析。特别对于英美法系国家，主要是以具体案例的形式介绍免 证特权的适用，希望能为我国立法的具体规定提供更加详细的借鉴。在论文的第 三部分，首先，介绍了我国历史上的亲属容隐制度以及台港澳的免证特权制度， 对比了国内外的免证特权制度的不同之处。其次，阐述了我国当前关于免证特权 制度的缺失现状，分析了我国为何无免证特权立法的原因。再次，对我国构建免 证特权制度的必要性和可行性进行了分析，免证特权制度应当并且可以在我国建 立。最后，对我国如何构建免证特权制度进行了论述。 关键词：刑事诉讼；特权规则；免证特权；权利保障 I ABSTRACT The testimonial privilege system is an important component of criminal evidence system. The testimonial privilege is established for the purpose of protecting human kinship relations and special professional relationship. In ancient time, China has the similar system which has extended to the 1940s. However, our present legislation does not establish the testimonial privilege system. In other countries, based on a higher level of social interest and the protection of the rights of citizens in criminal proceedings, the testimonial privilege system is provided more detailed and specific, the scope of privilege is also provided more broadened ,which could be reference for our future legislation. Thesis is divided into three parts. The first part introduces the concept of the testimonial privilege system and the development of theoretical basis. easily confused concept with the testimonial privilege is also described in detail. The second part of this chapter introduces the testimonial privilege system in other country. Particularly in common law countries, the testimonial privilege on the application is introduced mainly in the form of specific cases. My hope is to be able to provide more specific contents for our reference.
