论驰名商标及其反淡化保护 摘 要 驰名商标是指在一国范围内为相关公众广为知晓且享有较高声誉的商标。正是 由于其广泛的知名度及本身所代表的巨大的商业价值，近些年来对驰名商标的淡化 侵权现象越来越多，基于传统的混淆理论对驰名商标进行保护已经显得有点捉襟见 肘。商标反淡化理论能够为驰名商标提供更深层次的、更加全方位的保护。本文在 参考世界各国以及有关学者研究成果的基础上，主要从驰名商标本身、驰名商标反 淡化理论以及我国关于驰名商标反淡化保护方面的法律法规的具体规定三大方面作 了进一步论述，分析了我国对驰名商标反淡化保护的不足，并从立法的角度对完善 我国驰名商标反淡化保护的法律制度提出构思。 本文共分为四章：第一章首先从驰名商标的基本理论出发，分析界定了驰名商 标的概念、特征、认定机构、认定方式、驰名商标的价值和保护的意义。第二章分 析了世界各国对驰名商标进行保护的理论基础，即混淆理论、不当得利理论、联想 理论以及反淡化理论，然后简略比较了各种理论的优劣，得出对驰名商标进行保护 的必要性以及反淡化理论是现今保护驰名商标相对来说比较完善的一种理论。在此 基础上，第三章详细介绍了商标淡化的概念、法律特征、表现形式、商标反淡化理 论的历史发展以及当今世界各国法律法规关于商标反淡化立法方面的具体情况。第 四章在总结分析我国法律法规关于驰名商标反淡化保护规定的基础上提出关于我国 驰名商标反淡化保护方面的立法构思。 关键词：驰名商标，反淡化理论，反淡化保护 RESEARCH ON THE WELL-KNOWN TRADEMARK AND THE ANTI-DILUTION PROTECTION ABSTRACT Well-known trademarks refer to the marks that are widely known among relevant public and enjoy higher reputation in a national range. There is more and more invasion phenomenon to well-known trademarks in recent years because of it’s tremendous value. It’s not enough to protect well-known trademarks by the theory of confusion. The dilution theory can protect well- known trademarks better. The article analyses the deficiency of our protection for the well-known trademark and then gives some proposals to improve our legal system of well-known trademark dilution from the view of legislation. The article consists of four chapters. Chapter one is about discussion on the concept, characters, and the recognition of well-known trademark. Thus the necessity and importance to protect well-known trademarks is pointed out. Chapter two gives an interpretation on the protection theories for well- know trademark protection, including the theory of confusion, of association, of unjust enrichment, and of trademark dilution.
