 论“检调对接”的价值、结构与推行  中文摘要  论“检调对接”的价值、结构与推行 ——基于检察实证的分析 中文摘要 检调对接，作为基层检察实践，创造出有“系统特质”、具“地方属 性”的化解矛盾经验，在构建和谐社会大背景下凸显出其独特的价值。 自生发之日起，其扩展迅速但脉络纷杂。检察机关应当在厘清检调对接 内涵的基础上，智慧平衡其公正价值与和谐价值，理性构建包括轻微刑 事案件、民事申诉案件、涉法信访案件、涉法调解监督等在内的多元开 放结构。面对检调对接推行过程中影响法律平等适用、偏离调解自愿原 则、诱发司法腐败危险等种种质疑，检察机关已经采取了限定案件范围、 完善程序保障、发展和解方式、建设配套制度等多种措施予以回应。在 未来，我们应该以乐观心态和理性实践来推动检调对接在不断解决问题 中向前发展，从而更充分地发挥其在法治国家与和谐社会建设中的积极 作用，并为公众参与司法民主进程提供一个可资借鉴的模本。 关键词：检调对接 价值 结构 推行  作  者：施勤学  指导教师：方 潇 I Abstract  On the value, structure and operation of the combination of procuratorate and accommodation  On the value, structure and operation of the combination of procuratorate and accommodation Abstract As a common practice in the procuratorate work, the combination of procuratorate and accommodation has worked it way to dissolve contradictions, displaying both a systematic feature and a local flavor. The unique value of the practice has got its position in the background of building a harmonious country. The practice is widely deployed since its birth, while it has got many detailed branches to be attended. The procuratorate is supposed to balance justice and harmony on the basis of a correct understanding on the combination of procuratorate and accommodation, constructing a multi-phased structure including minor criminal cases, civil appeal cases, petition cases and mediation. In practice, the procuratorate has laid down restrictions on the scope of the case, perfected procedure guaranty, developed ways of mediation, established related systems to demolish the questioning resulted from the operations which might be against justice of law or the will of the litigants. The practice of a combination of procuratorate and accommodation should still be carried out in future with both an optimistic mind and a reasoning fulfillment, developing along a sound track while solving problems, thus giving a full positive play on the way of building a law-ruled country and constructing a harmonious society.
