浅析法治的代价 摘要：现代社会中，神治、德治与人治都逐渐失去了基础，法治成为主要治道，但当人们普遍认可法治重要性的同时，又可能会盲目地陷入另一误区，即将法治当作医治百病的良方，幻想不付出任何代价的法治。其实任何一种治国方略都不具有绝对的善，而仅是一种相对的善，法治本身并不是完美无缺的，我们在选择了法治优点的同时也选择了法治的弊端，这就是法治的代价。 本文的行文主线以法治的代价出发点，非为否定法治之道，实以其弊端而正其大道，欲为法治之完善、社会之和谐作点滴之功。拟从法治代价研究的现状与迫切性、现代法治代价的表现、产生法治代价的原因、如何避免与减少法治的代价四个方面展开论述。 关键词: 法治；法治的代价；多元纠纷解决；“共同体法治” Analysis on the Cost of Rule by Law Abstract: In contemporary society, the rule by God, the rule by virtue and the rule by man have gradually lost the foundation, and the rule by law has become a major strategy to govern state. The rule by law is generally thought important ever as a way to solve all problems. In fact, any kind of strategy to govern state has relative superiority. The rule by law itself is not perfect. Its disadvantages are accompanied with its advantages. That we chose the rule by law means that we chose its merits and defects, which is the cost of the rule by law. The article starts from the cost of the rule by law. It spells out the merit of the rule by law by disclosing its defects rather than denies the rule by law. The thesis of the article is how to perfect the rule by law and promote social harmony. This article tries to discus the status of urgency to study the cost of the rule by law, the performance of the cost of the rule by law, the causes of the cost of the rule by law and how to avoid and reduce the cost of the rule by law.
