内容摘要 未成年人监护是民事法律中一项重要制度，对保护未成年人健康成长有着重 要意义，近年来实践中大量出现未成年人遭受虐待、伤害等案件，暴露了我国监 护制度保护未成年人能力的不足，本文拟在通过案例的分析揭示我国现行未成年 人监护制度存在的缺陷，从国家监护责任角度，主要从未成年人人身权保护的层 面，参考主要西方国家流行的未成年人监护制度的改革成果，从实践角度提出我 国未成年人监护制度完善意见，建立以司法局为监护监督主体、民政部门福利保 障机构承担国家监护救济责任的一系列未成年人保护制度体系，以期为我国监护 制度的改革提供有益的参考。 除引言外，正文共分为四个部分： 第一部分：通过相关案例引入，引出文章所要探讨的核心问题：国家对未成 年人的监护责任、监护人的设立与变更及监护监督问题。 第二部分：通过我国现行未成年人监护制度概述，阐述监护的概念特征、性 质、监护人的职责，区分未成年人监护与亲权，阐明完善未成年人监护制度的必 要性：国家缺位未成年人监护已经导致了一系列严重的社会问题，完善未成年人 监护制度是法治理念变革、化解社会矛盾、承担保障人权义务、国家保护人民的 需要。 第三部分：探讨了监护人监护监督问题，通过分析我国监护监督制度的缺陷 并参考比较国外立法，将当今世界流行的监护制度与我国现行监护法律法规相结 合，提出完善监护未成年人监护监督制度的建议。 第四部分：探讨未成年人监护人的设立与变更的制度，分析我国监护人变更、 国家监护责任的承担等规定存在的不足，通过比较国内外立法，从现行制度架构 出发提出完善监护救济国家责任的建议。 关键词：监护；监护监督；监护变更；国家监护责任 1 万方数据 Abstract The guardianship of minors is an important system in civil law, and it is significant to protect minors to grow healthily.
