Laws The study on the right to know in our country Candidate: Wang Ping Supervisor: Prof.Zhen Shuqing Academic Degree Applied Master of Laws Specialty: Constitution and Administrative Law University: Hebei University Date of Oral Examination: May, 2012 摘 要 摘 要 知情权是一项新型人权，知情权已经被写入主要的国际人权公约之中，世界许多国 家也将知情权作为一项公民的基本权利给予法律保护。知情权的理论基础是人民主权原 则，权利与权力的动态平衡是知情权的现实依据。知情权是行使表达自由、监督权等其 他权利的前提，是公民生存发展的重要手段。知情权有私法上的知情权和公法上的知情 权之分，本文主要是对公法上的知情权进行论述的。 知情权的实现需要义务主体履行公开的义务，但是由于知情权保护的观念不强使得 权力机关的公开、审判机关的公开和政务信息的公开不彻底。另外，我国知情权保护的 法律制度也不健全。十七大以后，我国加强了对知情权的保护，但是我国宪法没有将知 情权纳入公民基本权利体系，关于知情权的规定散见在各个法律法规之中，对知情权的 缺乏系统的保护。2008 年实施的政府信息条例对保障公民的知情权有很大的作用，但仍 需要不断地完善。 保障公民的知情权是保障人权的需要，是遏制腐败的重要举措，是发展民主政治构 建和谐社会的重要渠道。保障公民的知情权需要将知情权入宪，从宪法层面给予知情权 最高的法律保护；同时应当完善部门法将知情权的保护具体细化到普通法律之中，使知 情权的实现具有可操作性；加强对知情权救济制度的完善，知情权受到侵害时能够给予 有力的保护；加强知情权的宣传，提高公民的维权意识，发挥社会组织的作用。 关键词 知情权 民主宪政 政府信息公开法 I Abstract Abstract The right to know is a new type of human rights, the right to know has been written to the major international human rights conventions, many countries around the world have given legal protection to the right to know as a citizens basic rights.
