论农地承包经营合同的法律性质 王权典、张建军 　　关键词: 农地承包经营合同/本质/法律制度 Farmland Operating Contract ; Nature ; the Legal System 　　内容提要: 由现行立法与法律实践分析表明，农地承包经营合同在本质上应属于一种民事合同，且是一种能产生物权关系的债权合同;其特有性质决定了法律调整的特殊性，该认识对完善相关法律规范设计颇具现实意义。 Analysis on the current legal system and the law reality indicates that Farmland Operating Contract can be categorized as both a civil contract and, a credit contract which implies the necessity to clarify some specific relationship on property rights. This special nature determines the importance to make corresponding adjustment in the process of legislation, which accordingly, contributes to
