关于渔业权的渔民社会保险制度研究.doc

上海交通大学MPA学位论文基于渔业权的渔民社会保险制度研究前执行情况及存在问题等的介绍分析，指出渔业权制度对于渔民社会保险的对象界定、资金来源、立法保障等问题具有重要影响。随后，本文从当前零散的渔民社会保险制度的发展现状入手，介绍分析了渔区合作医疗制度、“船东互保”制度、类似“退休金”制度等相关内容及存在问题，并对这些问题的共性原因进行分析，指出其根源在于渔民身份界定、渔民权益明确、渔民权益遭受侵害时的补偿等，而这些都与渔业权制度的完善、确立有着密切关系。基于以上分析，本文提出了基于渔业权的渔民社会保险制度构想，明确这一制度的构建原则应包括政府主导、凸显渔民特殊性、权利与义务对等、独立性与兼容性相结合。同时，本文还指出了这一制度的建立条件，并尝试性的对渔民群体进行了界定与细分，提出了“生存性渔民”、“发展性渔民”的概念。最后，本文明确指出，这一制度应以“低门槛、多层次、全覆盖”为总体模式，并就这一制度的对象、内容、筹资问题等进行了具体阐述。关键词：渔业权，渔民，社会保险II上海交通大学MPA学位论文基于渔业权的渔民社会保险制度研究STUDYOFSOCIALINSURANCEFORFISHERBASEDONTHEFISHERYRIGHTABSTRACTSocialinsurance,themaintenanceofsocialsecurity,playsanimportantroleforasenseofsecuritytomeetthepeoplessocialneedsandpromoteeconomicdevelopment.Atpresent,Chinassocialinsurancesystemmainlycoversurbanareas,forthevastruralareas,thesocialinsuranceisstillnearlyempty.Nowduetothecentralgovernmentgrowingimportanceofthreeruralissue,socialsecurityproblemsoffarmershavebeguntobeconcernedabouttheGovernmentandacademia.However,forspecificgroupsoffarmers-fishermen,theirsocialinsurancehasnotbeenenoughemphasisonthepartiesconcerned.Infact,thefishermenbecauseoftheirlackoflandsecurity,specialproductionmethodsandotherreasons,itisessentialtodistinguishthemfromthefarmersandtheestablishmentofspecializedtargetedsocialinsurancesystem.So,thestudyaboutsocialinsurancesystemtofishermenisgreatuseful.Inthisarticle，theauthoranalyzesonthespecificityoffishermanbasedonthetheoriesoffunction,intensionandsystemdesignofsocialinsurance.Narrowbyfishermenandfarmers,fishermenandurbanworkerstocarryoutcomparativeanalysisoftheparticularityoftheidentityofthefishermen.Theauthorexpoundstheeffectoffisheryrightuponsocialinsurancesystembyintroducingandanalyzingtheconceptoffisheryright；ThoroughlyanalyzestheIII上海交通大学MPA学位论文基于渔业权的渔民社会保险制度研究presentsituationoffishermansocialinsurancesystemtofollow，pointsouttheproblemsandsearchforthereasons.Basedontheanalysisabove，theauthorputforwardthefishermansocialinsurancesystemintheviewoffisheryright，andexpoundsontheprinciplesofconstructingthesystem，conditi
