大学生受教育权的法律保障的研究.doc

华北水利水电学院硕士学位论文把实践中发生的对大学生受教育权的各种侵害分为两种类型，即对大学生受教育权的实现造成严重影响的侵害（如对学籍权的侵害）和非严重的或隐性的侵害（如对教育资助权的侵害）。我国台湾地区在保障大学生受教育权方面积累了一些有益做法，特别是在大学生受教育权遭到严重侵害时的救济制度，对完善我国大学生受教育权的法律保障制度具有一定借鉴意义。基于大学生受教育权受侵害的突出表现，借鉴已有的探索和实践经验，根据依法行政的内在要求，为确保大学生受教育权的全面实现，应当建立完善的保障体系。要加快教育立法步伐，建立完整的教育法制体系，坚持正当程序原则，完善听证制度和教育仲裁制度，特别要以行政救济制度为重点，构建完善的申诉制度、行政复议和行政诉讼制度，并科学处理这些制度之间的关系，明确高校作为行政主体应承担的责任和义务。关键词：高等学校；大学生受教育权；法律保障；行政救济II华北水利水电学院硕士学位论文THERESEARCHONLEGALPROTECTIONABOUTTHERIGHTTOEDUCATIONOFUNIVERSITYSTUDENTSABSTRACTAccordingtothepresenttheoriesofhumanrights,thecoreofrighttoeducationistheresponsibilitiesstipulatedinlawandshoulderedbythegovernmenttomeettheeducationalneedsofitscitizens,namely,anequalrightandopportunitytoeducationthatcitizensacquirefromthegovernment.Franceisthefirstcountrytoincluderighttoeducationintoitsconstitution.ThefourconstitutionsenactedaftertheestablishmentofnewChinaallaffirmedcitizens’righttoeducation.ThedevelopmentofrighttoeducationindicatesthatnotonlyisitanimportantrightestablishedandguaranteedbysomeinternationaldocumentssuchasUniversalDeclarationofHumanRightsandInternationalConventionsonEconomic,SocialandCulturalRights,butitisalsoarightstipulatedbyamajorityofstatesintheirconstitutionsandlaws.Inrecentyears,asknowledgebecomesincreasinglyimportantinsocialprogressandpeople’slifeanddevelopment,therealizationofone’srighttoeducationhasattractedtheattentionofagrowingnumberofpeople.Asanimportantpartofrighttoeducation,collegestudents’righttoeducationisalsooneofthemostfundamentalrightsinconstitution.Therefore,besidesthegeneralnaturesofrighttoeducationlikeequalityandlegality,itisalsocharacteristicofautonomyandfreedom.Collegestudents’righttoeducationisasystemwithrichcontents,consistingofasequenceofrightsconcerningstudentship,theinceptionofdegreeanddiploma,etc.Alegalsystemwhichguaranteescollegestudents’righttoeducationhastakenitsinitialshapeinourcountry.SincetheestablishmentofnewIII华北水利水电学院硕士学位论文China,especiallytheimplementationofthepolicyofreformandopennesstotheoutsideworld,ourgovernmenth
