72 法律科学( 西北政法学院学报) 2005 年第 3 期 :( 2005) 030072( 11) 财产性利益是诈骗罪 对象 张明楷 ( 清华大学法学院, 北京 100084) [ ] 主张财产性利益是诈骗罪的对象, 具有合目的性与具体的妥当性, 并不违反罪刑法定原则( 不 于 类推解释) ; 但是, 只有当某种利益内容 于财产权, 具有管理可能性与转移可能性, 客观上具有经济价值, 被害人 丧失该利益必然同时导致财产损害时, 该利益才能成为诈骗罪对象的财产性利益; 至于债权凭证、财物的返还请求 权、货款请求权、财物的交付 请求权、债务的延缓履行是否刑法上的财产性利益, 则需要具体分析。 [ ] 诈骗罪; 犯罪对象; 财产性利益 Abstract:T he alleg ation that the interest of property is the object of the crime of sw indling acco rds w ith the aim of the criminal law has the concrete appropr iateness and do es no t violate the principle of a legally prescr ibed punishment for a specified cr ime ( not belo nging to analogical inter pretation) ; how ever the inter est could not satisfy the elements of t he interest of the property w hich is the obj ect of the cr ime of sw indling unless its content is par t of t he property rig ht has t he qualit y of manageability and transf er ability possesses economic value and inevitably leads to pro perty detriment simulta neously w hen the victim is deprived of the interest . As to the certif icate of cr editors r ights the claim for money or prop erty s restitutio n the claim fo r payment the claim for money or property s deliver y and the def er red performance w het her all of the above are the interest o f proper ty in the cr iminal law or not need specif ic analysis under diff erent condi t ions.
