Passage (II) Rights and Responsibilities of Lessees The rights of one party correspond with the respon- sibilities of the other party.The tenant has the right to expect the landlord to fulfill all legal responsibil- ities and vice versa. RIGHTS OF LESSEES Lessees hold an estate in real property and have ac- quired certain rights and interests by virtue of pay- ing consideration. To Be Left Alone This is called quiet enjoyment in the law. So the landlord can not excessively visit the property. He can not enter the property without permission or giving proper notice (usually 24 hours) for inspec- tion, except in case of emergency. To Assign the Lease Unless prohibited in the lease, the tenant shall have the right to assign the lease. This means to have a new tenant take possession of the property and take responsibility for the lease agreement, making payments directly to the lessor. If the existing ten- ant had to leave the property prior to the expiration of a lease, the tenant’s cooperation could help avoid a vacancy in the unit. It should be pointed out that assignment and sublet- ting are two different processes. Assignment causes the tenant to give up use and possession of the en- tire property and makes the assignee responsible for making the payment to the lessor. If the lessor has allowed the assignment he or she relieves the o- riginal tenant (the assignor) of all liability and ac- cepts the assignee as the debtor.
