摘 要 摘 要 利益衡量方法作为一种特殊的法律解释方法，从产生后就在理论界和实务界产生了 极大地影响。本文在法律方法的视角下，从研究现状、概念特征、必要性、具体应用及 利益衡量面对的困境及解决方法等角度出发，对利益衡量各方面作了详尽的论述；同时 因为利益衡量的个案性、先决性的特点，本文还以一些典型具体的案件为例，运用利益 衡量的方法对其上述内容进行了探讨、分析，试图通过案件中的现实利益的权衡和取舍， 来获得利益衡量适用时的具体规则。当然，利益衡量还有自身的局限性，需要进一步规 范，限制法官的恣意和滥用。 本文共分为三部分，着重探讨利益衡量的基本原则和利益衡量的实证分析。前两部 分主要是理论的研究与概述，着重分析了利益衡量的研究现及其基本理论，主要是为后 面的重点内容做铺垫。第三部分是本文的重点，此部分借用大量的案例来分析利益衡量 适用的具体原则及过程。同时也分析了利益衡量在审判实践中遇到的难题及解决方法。 关键词 利益衡量 法律解释 衡量原则 审判实践 I Abstract Abstract Interests of the measure as a special method of legal interpretation，from the produce after practitioners in the theoretical circle and had a great influence.
