危险驾驶入罪的司法困境与立法完善 中文摘要 危险驾驶入罪的司法困境与立法完善 中文摘要 2011 年2 月25 日第十一届全国人民代表大会常务委员会第十九次会议通过的《中 华人民共和国刑法修正案(八) 》，将危险驾驶行为纳入刑法规制范围。危险驾驶入罪 之前及之初，赞成者多，但其中也不乏反对之声。危险驾驶罪作为我国刑法体系中一 个新设立的罪名，还有许多不够完善的地方。国外危险驾驶犯罪立法相对比较成熟， 危险驾驶行为外延和犯罪构成均与我国立法有所不同，对危险驾驶行为的界定更加科 学和全面。立法机关将危险驾驶行为入罪，危险驾驶罪从无到有具有积极的现实意义。 对比国外立法经验，分析我国危险驾驶罪主观方面及犯罪构成，结合危险驾驶罪施行 一年多来的现实情况，归纳总结司法实践过程中遇到的种种困境与问题，不难发现我 国危险驾驶罪在行为外延、适用规范、配套制度等方面还需要不断完善。首先要在危 险驾驶罪的构成上作出适当调整，科学界定危险驾驶行为的外延，将酒驾和竞驾之外 的可能对公共安全造成威胁的其他危险驾驶行为以及危险驾驶其他公共交通工具的 行为纳入犯罪范畴；其次要按照罪刑责相适应的原则，针对不同的犯罪形态分别作出 相应的法律规定，设定合理的法定刑，提高危险驾驶犯罪成本，更好实现危险驾驶行 为入罪的立法初衷；再次要在司法实践过程中规范危险驾驶犯罪入刑标准，完善相关 立法，构建完善的危险驾驶犯罪法律评价体系。 关键词：危险驾驶罪 司法困境 立法完善 作 者：崔恒春 指导老师：孙 莉 I Abstract The judicial predicament with dangerous driving incriminate legislation perfect The judicial predicament with dangerous driving incriminate legislation perfect Abstract In February 25, 2011 Eleventh National Peoples Congress Standing Committee adopted the nineteenth meeting of the PRC Criminal Law Amendment ( eight) , will be incorporated into the scope of criminal law regulation of dangerous driving behavior.
