关于人工生育亲子关系认定的思考 法学专业学生 连丽英 指导教师 罗良 摘要：人工生育技术又称为人类辅助生殖技术，是指运用医学技术和方法，对配子、合子、胚胎进行人工操作，以达到受孕目的的技术。现代人工生育技术的发展，不但改变了人们的生育观念，也将由此带来的价值冲突渗透到了社会生活的各个层面，直接影响着人类本身的生存与发展。法律的规范、引导作用对人工生育技术的发展和限制是绝对必要的。我国生殖技术研究和应用比发达国家起步要晚，发展却相当迅速。但是，我国这方面的立法工作却极其落后，对生殖技术的应用管理也非常薄弱。本研究从法学专业的视角围绕当今在人工生育亲子关系认定方面所存在的主要争议和法律缺陷问题进行探讨，特别是对我过相关法律制度的完善提出了一些设想，以期对我国相关立法的完善有一定参考价值。 关键词：人工生育；同质人工体内授精；异质人工体内授精；代理孕母；儿童最佳利益原则 The Relevant Artificial Grows Parentage to Affirm of Thinking Student Majoring in Law LIAN Liying Tutor LUO Liang Abstract:The artificial grows a technique and is called mankind to lend support to grow a technique, meaning technique and method of the usage medical science, to the technique which goes together with son and matches son, embryo to carry on an artificial operation to conceive by attaining a purpose.The modern artificial grows a technical development, changing people to grow idea not only, will also the worth conflict which brings from here seep through each level of the social activities, influencing the mankinds existence and the development directly.The norm, leading function of the law are absolutely necessary to artificials growing technical development and restriction.The our country grows technique research and application to want a night than the flourishing and national start, but the development is very quick.But, our country the lawmaking of this aspect works but very fall behind, is also very weak towards growing technically of applying managing. This research learns professional angle of view circumambience and grow parentage and affirms in the artificial nowadays from the method main controversy and law blemish problem existed by aspect carry on a study, leading related law to me especially system of perfect put forward some conceive, to our country related lawmaking of perfect have certain reference value.
