Both the cosmetic surgery and traditional medical needs medical technology, but we need take more attention to their difference. It is not good for the development of cosmetic surgery industry ,and also not conducive to the protection of legitimate rights, If just attributed cosmetic surgery damage to a general medical damage. This paper is based on the differences in traditional medical and cosmetic surgery, and to see the application of the laws in China, combined with the judicial cases, analyzing the shortcomings of today’s cosmetic surgery damage relief system.
