中文摘要 海关自由裁量权是指海关在相关法律法规规定的权限范围内，就执 法行为的条件、程序，是否作为或如何作为进行合理选择的权力。这种 权力的实质是一种选择权，选择的主体是海关，选择的范围是法律法规 规定的权限，选择的内容是行政行为的条件、程序以及是否作为、如何 作为，选择的标准是“合理”。海关作为国家出入境监督管理机关，自 由裁量权贯穿于其整个行政管理活动的过程，海关监管、征税、缉私、 统计等执法任务的完成都有赖于自由裁量权的运用，可以说自由裁量权 是海关行政权力的重要组成部分。 自由裁量权是一把双刃剑，没有合理的规制和正确的运用势必引发 一系列相关问题。海关自由裁量权的行使也是海关行使行政权力中最具 有争议、引发矛盾最多的一部分，在行邮监管方面表现尤为明显。所谓 行邮监管是海关对进出境旅客行李物品和个人邮递物品的监督管理，其 具体业务包括对海、陆、空口岸进出境人员行李物品、邮递物品、快件 个人物品、分运行李物品、外交外商公私用物品和免税品的监督管理。 行邮监管执法工作直接面对各类进出境人员，时效性高、即决性强、政 策复杂、执法难度大，属于海关执法争议、行政复议或诉讼的高发区。 近年行邮业务自由裁量权的不恰当使用是一个较为突出的问题，主违禁 物品查扣、旅客随身携带物品征税等问题屡屡成为社会热点和海关执法 难点。 本文以海关行邮业务为例，主要采用案例研究方法，通过理论结合 实际的研究，对海关在行政执法中运用自由裁量权的现状进行分析研 究，对因滥用自由裁量权而引发的典型矛盾进行分析，在理论和实践方 面就合理运用和有效监督自由裁量权的运用提出建议，以进一步在海关 执法中体现公平、公正，实现行政正义，最大限度地维持自由裁量与法 律原则及规则的平衡，落实依法治国的理念。 关键词：海关；行邮；自由裁量 中图分类号D922．1 万方数据 ABSTRACT Customs discretion refers to the right of the Customs to choice reasonably in the realm of the conditions and procedures，of law enforcement behavior,and whether or how to take the action within the boundary limited by relevant laws and regulations．The essence of this power is an option．The major part of choice is the Customs．The range of choice is the permissions of the laws and regulations， and the contents are the conditions and the procedures of administrative acts，，and whether or how to take the action．ne standard of choice is”reasonable”．As the national immigration authorities．the Customs implements discretion throughout its entire process of administrative activities．111e accomplishment of the law enforcement tasks of the Customs such as supervision，taxation， anti。smuggling and statistics will depend on tlle use of discretion．That is why we call discretion an important part of the Customs administrative powers． Discretion is a double—edged sword．A series of related problems could be triggered inevitablv if there IS no reasonable regulation and the correct use of discretion．nle exercising of Customs discretion IS also the most controversial part in the exercise of Customs administrative power
