论婚内强奸若干问题 摘要：婚内强奸是最严重的家庭暴力之一，但是受传统观念以及婚姻关系存续期间男女两性关系特殊性的影响，“婚内强奸”行为一度被排除于犯罪的范围之外。。有的学者认为在我国婚内不存在强奸的问题，而大部分学者则认为，在婚姻关系存续期间丈夫对妻子实施的强迫性行为仍然构成犯罪。从保护妇女合法权益的角度出发，已婚妇女对丈夫仍然享有性的自由和权利，婚内强奸行为应当在合理的范围内被刑法规制。但是又应该怎么定罪？是不是婚内强奸应该按照现行刑法认定为强奸罪？婚内强奸有着自己的特殊性，因而成为了近些年来刑法学界讨论的热点问题, 也是社会关注的热点问题。在刑法学界对婚内强奸问题展开了广泛的讨论乃至于争论。从现有的讨论来看, 大多将关于婚内强奸是否应当犯罪化的观点归结为两种: 肯定说与否定说。本文对婚内强奸进行了概述，对域外婚内强奸的定性和国内对婚内强奸的争议进行了阐述，通过两起典型的案例进行分析，笔者认为婚内强奸严重损害了妇女的权力，在国内婚内强奸已经具有了立法的必要性，提出了对婚内强奸进行立法的构想。 关键词：婚内强奸；强奸罪；入罪；立法 A Number of Issues on Marital Rape Abstract: Marital rape is one of the most serious domestic violence, but by men and women of the traditional concept of marriage during the existence of relations between the sexes particularity, marital rape behavior was excluded from the scope of the crime. .
