试论现代海洋法的发展 【内容摘要】现代海洋法是国际法的重要组成部分，是关于各种海域的法律制度，它有着一个逐渐完善的发展过程，研究现代海洋法的发展有助于在实践中认识到它的根本矛盾、不足及发展趋势。本文将从海洋法的历史、第一次联合国海洋法会议的新发展、《联合国海洋法公约》的新发展以及现代海洋法面临的挑战与未来的发展趋势这几个方面对现代海洋法的发展问题进行梳理和研究。论述对象主要是现代海洋法中的国际多边条约和海域制度的发展过程。 【关键词】国际法、海洋法、现代海洋法、发展、海域。 【Abstract】The modern law of the sea is an important part of international law, is the legal system on a variety of sea, it has a gradual improvement of the development process, helps to recognize the fundamental contradictions, problems and the development trend of it in practice to study on the development of modern law of the sea. In this paper, the law of the sea, from the history of the first United Nations Conference on the law of the sea, the new development of the United Nations Convention on the law of the sea and the new development of modern law of the sea facing challenges and future development trend of the aspects of the modern law of the sea development problem analysis and study. The main object is to discuss the process of the development of modern law of the sea in the international multilateral treaties and sea system. 【Key?words】International Law；The law of the sea;The modern law of the sea;Development;Sea area 海洋是生命的发源地，是人类宝贵的自然资源。海洋法是国际公法的一个重要分支，是关于各种海域的法律地位以及各国在各种海域从事各种活动的原则、规则和制度的总称。其内容主要包括海域制度、海洋环境保护与海洋管理、海洋争端的解决、战时海洋法等。海洋法是国际法中最古老的法律部门之一，它经历了一个漫长的发展过程。 一、海洋法的发展历史与现代海洋法 法的发展是指一种法律规范进步变化的过程，由小到大，由简到繁，由低级到高级，是一种连续不断的更新变革过程，这种法的内在发展过程表现出来就是法的发展历史。现代海洋法的发展是整个海洋法发展的一部分，是过去海洋法发展历史的延续，所以研究海洋法整体的历史可以把握现代海洋法的发展脉络，分析历史的表象可以发掘发展的实质。 海洋法依次经历了古代海洋法、中世纪海洋法、近代海洋法一直到现代海洋法的发展历史。古代海洋法是公元6世纪以前的海洋法，萌芽于古罗马的奴隶制社会，但是当时社会生产力低下，海上交通不便，海洋不被重视，所以海洋法发展缓慢。中世纪海洋法是公元6世纪至16世纪，欧洲进入封建时期，社会生产力得到提高，人口增多，国家之间交往频繁，海上交通发展迅速，各国开始相互间争夺海洋权益。虽然仍未出现海域划分，但是十五和十六世纪开始的远洋航行让当时的主流国家意识到了海洋的重要性，这时海洋法进入近代时期。十六世纪开始的地理大发现以及欧洲资本主义的快速发展使欧洲国家将目光投向整个世界，巨大的利益驱使他们不断拓展海外殖民地，发展海上贸易，甚至进行奴隶贩卖贸易，人类的踪迹开始遍布五湖四海。对海洋利益的争夺日益激烈，特别是葡萄牙、西班牙、荷兰、英国这些海洋大国之间的斗争，海洋应不应该像陆地一样被分割成了争议的焦点。因为与陆地不同的是，海洋在当时主要用于交通，被分割不利于资本主义经济的发展，于是出现了以荷兰著名法学家格劳秀斯为代表的海洋自由论，主张公海自由原则。但是也出现了相对立的闭海论，主张国家对
