论量刑规范化制度的缺陷及完善 摘要 刑事审判活动包括定罪与量刑两方面。在英美法系国家，将定罪与量刑放在同样重要的地位，即把定罪程序与量刑程序完全独立开来。而大陆法系国家，却将定罪与量刑作为一个整体来对待。这就导致在审判过程中出现量刑偏差的问题，从而影响了司法公正。而我国亦是将定罪程序与量刑程序混合在一起，因此，无论在理论界还是实务界都将量刑公正问题推到了浪尖。而要实现量刑公正问题，就必须实现量刑的规范化。随着《人民法院量刑指导意见（试行）》和《人民法院量刑程序指导意见（试行）》以及《关于规范量刑程序若干问题的意见（试行）》的相继出台，我国量刑规范化取得了初步的成效，但在实行过程中，也显露出了其所存在的问题。本文笔者将主要对量刑程序这一块进行阐述，指出量刑规范化所存在缺陷，并提出完善的建议。文章将分四部分进行：第一部分，主要说明我国量刑规范化的内容及执行情况，阐述我国量刑规范化的具体内涵以及在实践操作中所带来的成效。第二部分，指出目前量刑规范化制度所存在的问题。第三部分，则是通过阐述两大法系对于量刑程序的不同规定，从而推导出我国应当借鉴英美法系国家的经验，建立起相对独立的量刑程序。第四部分，则是文章的重中之重，根据前文所述，得出完善我国量刑规范化制度的建议。使得本文的研究兼具理论意义与实践参考价值。 关键词：量刑规范化；相对独立量刑程序；基准刑的确立；量刑监督 Abstract Criminal justice activities include the conviction and sentencing of two aspects.In the countries of Anglo-American law system, the conviction and sentence on the same important position, namely the conviction and sentencing procedure totally independent program.And the countries of continental law system, but the conviction and sentencing as a whole.This resulted in the trial process in the sentencing deviation problem, thus affecting judicial justice.But China is also the conviction and sentencing procedure procedure mixed together, therefore, whether in the theory circle and practice circle will fair sentencing issues to the waves.In order to realize sentencing fairness problem, must realize the standardization of the sentencing.As the peoples court sentencing guidelines (Trial) and the peoples court sentencing guidelines (Trial) and on the norms of sentencing procedure questions (for Trial Implementation) come on stage in succession, Chinas sentencing standardization has achieved initial results, but in the implementation process, but also revealed its the existing problems.This paper will mainly on the sentencing procedure the block carries on the elaboration, pointed out the shortcomings of standard sentencing, and puts forward some improvement suggestions.The article will be divided into four parts: the first part, mainly to explain Chinas sentencing standardization,
