中国检察官独立作用机制研究 重庆大学专业硕士学位论文 学生姓名：王 璐 指导教师：赵 骅 专业学位：EMBA 重庆大学经济与工商管理学院 二OO九年十一月 Study on the Chinese Pattern of the Prosecutor Independent Mechanism A Thesis Submitted to Chongqing University in Partial Fulfillment of the Requirement for the Degree of Master of Profession By Wang Lu Supervised by Zhao Hua Profession: Executive Master of Business Administration College of Economics and Business Administration Chongqing University, Chongqing, China Nov. 2009 摘 要 1998年以来，检察改革成为检察工作的主旋律，在探索中取得了显著成就。而各项检察业务改革措施中最先推行的是主诉检察官办案责任制。2000年1月，最高人民检察院制定了《检察改革三年实施意见》，作为检察改革的指导性文件；2000年初又制定下发了《关于在全国检察机关审查起诉部门全面推行主诉检察官办案责任制的工作方案》，决定从2000年1月起，在全国检察机关审查起诉部门推行这一制度。从整体上讲，主诉检察官办案责任制的推出，建立了相对明确的责任机制，使错案追究制得以落实；淡化了公诉工作中的行政色彩，使审查起诉工作更加符合公诉工作亲历性、程序性、规范性等特点，明显提高了办案效率和质量，增强了主诉检察官的工作责任心，推动了检察人事改革，为检察工作注入了强大的活力。 在赞歌四起的同时，我们也深深感到主诉检察官办案责任制存在问题。主诉检察官办案责任制以办案责任制为突破口的改革，由于缺乏对主诉检察官的准确定位，缺乏以此定位而展开的对主诉检察官的遴选、考核、保障、监督等机制来支撑，已陷于进退两难的困境之中。对主诉检察官办案责任制改革的再改革已迫在眉睫。本文中，我们提出了改革的方向——主诉检察官制度改革，并以全新的视角，深入剖析了改革的各项制度，构建了一套完整但略显粗糙的制度体系，以期为推动检察改革贡献自己的绵薄之力。 本文围绕对主诉检察官的权利性质及其定位进行分析，对主诉检察官制度体系进行优化，通过实施主诉检察官制度，将形成完善的主诉检察官遴选、淘汰机制，建立主诉检察官、助手、书记员的合理的人才梯队，实现主诉检察官精英化、专业化。 本文主要分为五个部分：第一部分主诉检察官制度概论，第二部分主诉检察官权利性质论，第三部分主诉检察官地位研究，第四部分主诉检察官制度运行改革论，第五部分主诉检察官选任制度研究。 主诉检察官制度，检查权，改革  ABSTRACT Since 1998, the Attorney reform has become the main theme of prosecutions,and has made remarkable achievements.
