第 29卷 第 1期 石河子大学学报(哲学社会科学版) Vo1．29 No．1 20 1 5年 2月 Journal of Shihezi University(Philosophy and Social Sciences) Feb．20 1 5 URI：http：／www．enki．net／kcms／detail／65．1210．C1341．002．html 司法裁判可接受性的法社会学之维 胡平仁，刘冬泉 (中南大学 法学院，湖南 长沙 410083) [摘 要]基于法社会学的民间立场与法律接受理论 ，司法裁判的可接受性实际上是接受主体 、接受对 象和裁判主体三者之间的关系。从接受对象来说，司法裁判活动既是形式逻辑的认识过程，也是含有价值 评价因素的实践认识过程。就接受主体来讲，除了利益考量和理性权衡之外，司法裁判还必须考量当事人 和社会公众对法律制度的普遍期待。就裁判主体而言，要使司法裁判具有可接受性，需具备良好的专业素 质 ，秉持公平 、公正的立场，以及对各方当事人的亲和性。法治乃全体国民之事，司法场域更是法律精英话 语与大众话语交汇与交流的平台。只有围绕无数的司法个案，经历法律精英话语与大众话语之间长时期的 相互进入与纠缠的过程，中国的法治思维和法治精神才能真正地落地生根 ，司法裁判才能在个案与整体两 个层面具有更大的可接受性 ，真正为社会公众所认同。 [关键词]司法裁判可接受性；法社会学 ；民间立场；接受理论 [中图分类号]D920．0 [文章标识码 ]A [文章编号]1671—0304(2015)01．0077．05 Legal and Social Dimension of Acceptability of Judicial Decision HU Ping—ren，LIU Dong—quan (Law School，Central South University，Changsha 410083，Hunan，China) Abstract：Based on the folk standpoint of sociology of law and reception theory of law，the acceptability of judicial decision is actualy the relationship between the reception subject，the object and judicial subject． For the object，judicial decision is not only a recoginzing process of formal logic，but a pratical evaluative process．For the reception subject，besides considering the interests and balance reasonably，judicial decision should take into consideration the common expection of the party and the public．For the judicial subject， to make the judicial decision acceptable，they must have a good prefessional caliber，act fair and square and have an afinity to every party．Rule of law is everyone’S busines and judicial field is the platform of connection and communication betw een the legal elites and the public．Only after numerous law cases of lasting confrontation of discourses between the elite and the public，can judicial decision gain a larger acceptence dimension and be truly recognized by the public． Keywords：acceptability of judicial decision；sociology of law；folk standpoint；reception theory 迄今为止的中外法学研究 ，过分局限于西方法 学的研究框架，过分局限于自上
