20 13 年第 3 期 法律科 学( 西北政法大学学报) ·45 · 文章编号:1674 － 5205 (20 13)03-0045-(0 11) 行政自由裁量基准质疑 关保英 ( ， 20 170 1) 上海政法学院院长办公室 上海 〔 〕 ， 摘 要 行政自由裁量基准是近年来我国行政法学界和行政法治实践关注的热点 其在理论和实践中似乎 都已趋于成熟。 ， : ， 然而 这一命题存在重大理论误区和实践困惑 作为基准的规则将裁量行为变为羁束行为 将外部 ， ， 。 ， 行为内部化 将行政个案处置抽象化 将行政权利变为行政义务 基于此 对行政自由裁量权的控制还是应当回归 。 、 、 到法律原则中来 传统的自由裁量权控制原则如比例原则 重大事实的误认无效原则 正当目的原则和平等原则 。 。 等都是有用的 在此基础上我们亦可以建构一些具有我国特色的裁量原则 〔 〕 ; ; 关键词 行政自由裁量 裁量基准 法律原则控制 Abstract :Administrative discretion benchmark is a hot issue in the administrative law and administrative law practice in China ，which seems to have been mature in theory and in practice． However ，there is a significant theoretical misunder- standing and practical puzzle in this proposition :the benchmark acting as the rules will turn the discretionary behavior into restrictive behavior ，internalize the external behavior ，abstract the disposal of administrative cases ，change the administra- tive rights into administrative obligations ，on the basis of which the control of administrative discretion should return to legal principles． The traditional control principles concerning discretion such as the proportionality principle ，the principle of mistaking major fact is invalid ，the principle of proper purpose ，and the principle of equality are all useful ，on this basis of which some discretion principle may be established with Chinese characteristics． Key Words :administrative dis
