我国公众参及地方经济立法困境及出路 　　摘要：公众参与地方经济立法切实能在经济建设、市场决策、民主理念、公民意识等方面发挥积极作用。它是实现经济良法之治的基本途径，能将上下位法冲突降至最低限度，能推进社会公众经济法治意识的培育。公众参与地方经济立法有着丰富的理论来源和完备的现实依据。应在科学理性、民主法治条件下认识地方经济立法在实践中存在的困境问题，冷静探寻其困境之原因，客观分析其存在的社会基础，推动地方经济立法之科学、民主及其规范化。探索并分析公众参与地方经济立法的合理化出路，制定公众参与地方经济立法的制度规则，拓宽信息公开途径，提升其经济法治意识，健全权利表达机制 关键词：公众参与；经济立法；利益表达；信息公开；民主法治 中?D分类号：D91229文献标志码：A文章编号：1671-1254（2017）01-0034-07 The Dilemma of Chinese Public Participation in Local Economic Legislationand its Solutions DING Guofeng， CHEN Mingchen （Faculty of Law， Kunming University of Science and Technology， Kunming 650500， Yunnan， China）Abstract：Public participation in local economic legislation can play a positive and effective role in economic construction， market decision， democratic ideas， civic consciousness and other aspects. Public participation in local economic legislation is the basic way to realize the good rule of economic law， which can help to diminish the conflicts between the upper laws and lower laws to the minimum， and promote the cultivation of the consciousness of public’s rule of economic law. The public participation in local economic legislation has abundant theoretical sources and complete practical basis. We should understand the dilemma of local economic legislation in practice under the conditions of scientific rationality， democracy and rule of law， explore deeply the causes of its predicament， analyze objectively its social basis， and promote the local economic legislation of science， democracy and its standardization. We should explore and analyze the reasonable ways of public participation in local economic legislation， formulate systematical rules of public participation in local economic legislation， broaden the channels of information disclosure， enhance our awareness of economic rule of law， and improve the rights expression mechanism.
