摘要 摘 要 器官移植技术的迅速发展给器官疾病患者带来了福音。虽然我国的器官移 植医学临床起步较晚，但器官移植技术的进步相对较快。尤其是近年来，我国 的器官移植技术发展迅速，规模扩大。然而于此相对，尽管我国在器官移植的 医学实践方面已经跨入世界先进领域，但对器官移植的法律研究和相关立法却 比较滞后，这一点导致了人体器官在摘取、移植的过程中面临着许多需要解决 的法律问题和需要完善的法律空白地带。鉴于此我国立法机关可以借鉴国外的 立法经验，在现有的器官移植相关法律法规的基础上，进一步制定器官移植和 器官捐献统一的法律来完善器官移植的法律体系，以推动我国器官移植事业的 健康发展，挽救更多患者的生命。 本选题分为三个部分。第一部分从立法目的、立法适用范围以及法律基本 原则对中德器官移植法的一般规定进行比较。第二部分对中德器官移植法的基 本制度分别予以介绍，进行供体、受体范围、医生说明义务、捐赠者同意等方 面的对比。第三部分是对中德器官移植法法律责任的比较分析。每一部分中都 对我国立法需改进的地方提出了本文的见解与建议。 关键词：器官移植；人体器官移植条例；比较分析 II 万方数据 Abstract ABSTRACT The rapid development of organ transplantation brings the gospel to the patients with the loss of organ function.
