摘要 摘要 跨国公司环境侵权问题并不陌生，在世界各地都有案例，尤其出现在经济 不是很发达的发展中国家，而随之带来的首要问题就是它的司法管辖权问题。 本文研究主要是针对跨国公司的母子公司而不涉及总分公司。司法管辖权问题 是国际私法运作的核心问题和中心环节，也是承认与执行外国判决中的核心问 题，关系到一国的司法主权，并直接影响案件的适用法律和实体结果。本文主 要是详细地介绍跨国公司环境侵权司法管辖权问题，使我们能够有一个清楚的 认识，以期能为我国的立法和实践提供帮助。 本文由四部分内容组成：第一部分，跨国公司环境侵权中的司法管辖权概 述。第二部分，具体跨国公司环境侵权案件中所体现的司法管辖权问题分析。 第三部分，跨国公司环境侵权中的司法管辖权产生冲突的原因。第四部分，跨 国公司环境侵权中的司法管辖权冲突的协调。 关键词：跨国公司； 环境侵权； 司法管辖权； 冲突 II 万方数据 Abstract ABSTRACT Transnational environmental infringement is not strange, there are many cases happened around the world, especially in developing countries. And then the first problem is its jurisdiction. In this paper, we study mainly for transnational parent-subsidiary company and not to the parent company and its branches. Jurisdiction is the core and the center link of international private law, also is the key problem in recognition and enforcement of foreign judgments, is related to a countrys judicial sovereignty, and directly affect the case applicable law and the real result. This paper mainly introduces in detail the jurisdiction of the transnational corporations’ environment infringement. It enables us to have a clear understanding, and also provide help for our country’s legislation and practice.
