体育运动中兴奋剂行为纳入刑法若干问题的研究 ABSTRACT The doping problem in China appears in 1980s. Since then, the anti-doping war was emerging from passive to positive legislation in China. After the Olympics and Paralympics was successfully hold in Beijing, we should absorb the experience of other countries and legislate the beneficial anti-doping works, thus enhance the legislation framework of anti-doping in China by learning and using Olympics Spirit and advanced experience of other countries. This paper starts from the spread of doping problem in China, illustrates the harm of exhilarant drugs, therefore point out that the spread of drugs has severely damaged the sports spirit, caused harm to the health of athletes, made manipulating the result of sports game possible and causing other forms of crime as well. The development of technology and other athletes following action makes the hardness of anti-doping war worse. The diversity of subject and appearance of drugging behavior further enhanced the difficulty. Therefore, we have to research the trend of anti-doping war, use effective arbitration and implement laws and eliminate drugging behavior. The necessary of legislation of anti-doping has three aspects. The first is the necessary of carrying out Three Strict policy to strike drugs. The Three Strict policy is the basic policy of dealing drugs in our country, which is always directing the restriction of drugs from policy. The second is to dealing drugs by the law. The reflection of the policy of manage state affairs according to law in anti-doping field is to control drugs according to the law.
