流通环节食品安全监督管理办法(Measures for the supervision and administration of food safety in circulation) Measures for the supervision and administration of food safety in circulation Measures for the supervision and administration of food safety in circulation (promulgated by Decree No. forty-third of the State Administration for Industry and Commerce on July 30, 2009 and effective as of the date of promulgation) Chapter I General Provisions Article 1 in order to strengthen the circulation of food safety supervision and management, maintaining the order of the food market, according to the Peoples Republic of China food safety law (hereinafter referred to as the food safety law), Peoples Republic of China Food Safety Law Implementation Regulations (hereinafter referred to as the Regulations the implementation of the food safety law) and other laws and regulations, the enactment of this approach. Article second in the territory of Peoples Republic of China engaged in the circulation of food business, should comply with these measures. Third food operators shall, in accordance with the laws, regulations and food safety standards, engage in food business activities, establish and improve the food safety management system, and adopt effective management measures to ensure food safety. Food operators are responsible for food safety, social and public responsibility, and social responsibility. Fourth administrative departments for Industry and Commerce shall, in accordance with the laws, regulations and the functions prescribed by the State Council and the provisions of these measures, supervise and manage the food safety in the circulation. Fifth administrative organs of industry and commerce at the county level and above shall be under the unified leadership of the local peoples governments and be responsible for the supervision and administration of food safety in the circulation areas within their respective jurisdictions.
