利害關係人在台灣地籍清理之角色探討 鄭榮發1 紀雲曜2 郭金惠3 李雅芬4 (1. 長榮大學 土地管理與開發研究所，台灣） (2.長榮大學 土地管理與開發系所 副教授，台灣) (3.高雄大學 高階經營管理研究所碩士，台灣) (4.稻江科技暨管理學院 休閒遊憩與旅運管理學系 助理教授，台灣) 摘要 台灣地籍清理之範疇，對象主體包括祭祀公業、神明會、神祉、未登記之寺廟或宗教團體，時間自清末及日據時代以來，涵蓋1945年10月24日前之限制登記、1949年12月31日前登記之抵押權及法定物權、1956年12月31日前登記之地上權等，這些待清理之土地，估算市值約達新台幣7兆元，但由於清理時牽涉錯綜複雜的相關人員，至今不但清理速度緩慢，也影響到國家土地的有效利用。 利害關係人於企業社會責任(CSR)與公司治理各領域越趨重要，本文乃根據利害關係人理論，以個案來進行利害關係人在台灣地籍清理時之角色探討。本文首先臚列祭祀公業及神明會地籍清理時的關係人，並以這些關係人對地籍的權屬加以分類，再透過個案研究，獲得祭祀公業及神明會地籍清理時的利害關係人，為祭祀公業之派下員、管理者、公務單位之地政單位及鄉鎮區公所之民政單位、負責溝通協調之地政士及相關人員等，這些利害關係人於台灣地籍清理角色扮演的認知與配合，更是地籍清理能否成功關鍵。希望以此研究探討，來加速地籍清理之成效，促進土地利用，將國家社會民眾資源做最有效的利用。 關鍵詞：利害關係人、祭祀公業、神明會、地籍清理 鄭榮發(10/22)，性別：男性，籍貫：台灣。職稱：社團法人高雄市不動產交易安全協會 理事長 主要研究方向：探討利害關係人於台灣地籍清理之角色扮演及如何共同促進土地利用與國家社會資源。 電子信箱：alan6688@Study on the characteristics of competent actors for cadastre rearrangement of the associations of deities via the stakeholder analysis Jung-Fa Cheng, Yun-Yao Chi, Chin-Huei Kuo , Ya-Fen Lee ABSTRACT The objects of cadastre rearrangement are including the associations of deities, non-registered temple and religion in Taiwan. The periods of the cadastre rearrangement objects are (1) non-registered before 24 October, 1945, (2) property hypothecated before 31 December, 1949, (3) surface rights registered before 31 December, 1956. The market capitalization of land of cadastre rearrangement is about 233 thousand million US dollars in Taiwan. The works of cadastre rearrangement are time consumed and difficulty because the complex of relational party and rearrangement process. For nation and local area development benefit, cadastre rearrangement is one of important topics of land utility. Stakeholder analysis is widely applied in the study of corporate social responsibility (CSR) and company management. This paper aims the characteristics of competent actors for cadastre rearrangement of the associations of deities via the stakeholder analysis. Firstly, the influence members are listed by case studies. Secondly, the characteristics of competen
