论韩非学术思想的演进历程 喻中 首都经济贸易大学法学院 韩非的学术思想是中国法律文化的一个重要纽结。从韩非学术思想的演进历程来 看，少年吋代的韩非主要学习申不害之学，创作《和氏》篇，是为韩非学术思想 的起点。青年时代的韩非精研黄老道家的思想，创作《解老》、《喻老》。屮年 时代的韩非师事于荀子，受荀子的影响，创作《奸劫弑臣》、《杨权》等篇。在 韩桓惠王末年与韩王安时代，壮年时代的韩非创作《有度》、《爱臣》、《忠孝》 及《饰邪》诸篇，以之作为“谏韩王书”，体现了当下所说的“研以致用”的追 求。公元前234年，年过六旬的韩非进入晚年，他出使秦国，创作了《存韩》、 《初见秦》，并以《难言》作为绝笔之作。历史性地理解韩非学术思想的起点、 深化、拓展与定格，是全而理解韩非学术思想的必要环节，是深入阐述中国法律 文化的必要准备。 关键词： 韩非;法律文化;法家;韩学; 喻屮(1969-),男，重庆人，法学，首都经济贸易大学法学院 教授、生导师，研宄方向为法理学。 基金：W家社科基金项目“先秦法家治W理政观的当代价值及其创造性转化研 宄” (16XZX008)的阶段性成果 The Evolution of Academic Thoughts of Han Fei Yu Zhong Law School of Capital University of Economics and Business; Abstract： Han Fei’ s academic thought is an important knot of China legal culture. From the evolution of Han Fei’ s academic thought, the young age of Han Fei mainly learning the shought of shenbuhai, he created the “He shi” which was the starting point for Han Fei’s academic thought. As a young man, Ilan Fei studied the thoughts of Lao Huang and created “Jie Lao” and “Yu Lao’，? At the Middle age, Han Fei learned from Xunzi，and been influenced by Xunzi，and created “Jian Jie shi chen” and “Yang Quan” and other articles. In the era of King Huanhui of Han and King an of Han, Han Fei created the “You Du” and uAi Chen” and other articles- In 234 BC，over sixty years，Han Fei entered old age，he went to Qin, and created “Cun Han”， “Chu Jian Qin” and “Nan Yan” as Swan song. A diachronic understanding of the starting point, deepening, expanding and setting up of Han Fei’s academic thought is a necessary link for a comprehensive understanding of Han Fei’s academic thought and a necessary preparation for an in-depth exposition of Chinese legal culture.
