However, it also aroused much controversy on the right of the use of the trademark between Dayu and Shengda. The case has lasted for more than three years. In 2007, Dayu lost the case and in 2010, the court has affirmed the original judgement. The judge thought that monopoly has became the a generic name. So the Shengdas use of this trademark is fair use rather than tort. With the annocement of the result of this case, the fair use of trademarks has been a hot issue which aroused much controversy and new legal problems. The articles object of study is the fair use of the trademarks. Using the way of documents and cases analysis, the writer introduced the Monopoly case and the problems involved in the case, analysised the concept of the fair use of trademarks, the type of fair use.constitution factors of fair use. After introduced the domestic law involved the fair use of trademarks and foreign laws , the writer summarized the weak point of the law and put forward several suggestions.
