摘 要 近年来,伴随着劳动力市场竞争日趋激烈,就业压力逐渐增大,劳动者就业困难已成为一种客观现实。面对这一情况,用人单位在劳动关系中的强势地位逐渐突显出来,用人单位利用其强势地位,对劳动者违约的现象逐渐增多,这不但破坏了我国劳动关系的和谐稳定,阻碍劳动力市场的健康发展,而且侵犯了劳动者的合法权益。《中华人民共和国劳动合同法》(以下简称《劳动合同法》)的颁布,对用人单位的违约责任作了进一步的规定,在很大程度上完善了以往立法中的空白,对于规范劳动关系,保护劳动者的合法权益发挥了至关重要的作用。然而,随着劳动关系实践的不断深入,《劳动合同法》关于用人单位违约责任之规定也逐渐暴露出一些问题,尚存在一些不完善的地方,如关于用人单位违反服务期的责任规定不明确,关于用人单位的违约金责任的规定缺失,对继续履行的规定不够具体详细等。本文从目前的劳动关系实践和法律规定出发,对于《劳动合同法》规定不完善之处提出了相关的立法建议,以期在理论上能够完善目前的劳动合同制度,在实践上可以进一步协调劳动关系,促进劳动关系的和谐稳定,更好的保护劳动者这一弱势群体的合法权益。 关键词:劳动关系 用人单位 违约责任 问题 完善 ABSTRACT In recent years, with the labor market competition becomes increasingly fierce, the pressure of the employment increases gradually. The difficulty of getting employed has already become a kind of objective reality. Facing this situation, the powerful position of the employing units in labor relations is gradually apparent. The phenomenon of breaching contract increases gradually, and this not only does damage to the harmony and stability of our country labor relations, but also hinders the healthy development of the labor market and violates the lawful rights and interests of workers. The labor contract law of the Peoples Republic of China is the issuance of the responsibility of breach of contract for employing units and makes further regulation. It largely perfects the past blank and plays a crucial role in protecting the lawful rights and interests of employees. However, with the deepening of the labor relationship practice, the law about the employing units of the liability for breach of law shall also gradually exposed some problems, and there are still some drawbacks. This article is based on the current labor relations and wants to put up with some legislative suggestions. So it can improve the current labor contract system in theory and coordinate the labor relations in practice. In this way, we can promote the harmonious and stable employment relationships and protect employers legitimate rights and interests. Key words: labor relations; employing units
