Louisiana Civil Law as Applied to Life Insurance Leon S. Cahn* Louisiana, alone among the states of the Union, derives its structure of private law from the civil law of France, from the same origins as the French Code Napoleon. Those states which owe their community property systems to their Spanish ante- cedents nevertheless take the remainder of their precedents largely from the common law. On the other hand, in Louisiana the French civil law, as embodied in the civil code, is the background of almost every private relationship. Therefore, in treating of the effect of Loui- siana law upon the rules of life insurance, it is not sufficient to consider only the community property system. Other civil law doctrines, such as those of forced heirship and other restrictions upon donations, must be taken into parallel account, since the interpretations by the courts involve the entire philosophy of the civil law.
