On Provincial Constitutional Movement in GuizhouAbstractProvincial Constitutional Movement is an important part in Chinese constitutional study and practice. Though it failed, there is something can be discussed. This movement can be divided into three parts, which are the period of Han Military Government (the year of 1911), the period of Nation-protection Military Government (the year of 1922), and the period of Constitution of Consultative Bureau (the year of 1922). The Code of Organization of Guizhou Military Government, the Code of Constitutional Draft of Guizhou Parliament, and the Code of Organization of Guizhou Prime Minister and its Bureau have been made down.Seen from the context of Provincial Constitutional Law, the feature can be concludes as follows, (1) the appearance of the conception of rights, (2) the legal regulation of rights, (3) simple content of rights, (4) the relationship between rights and duties, and (5) the limitation of duties. Parliament enjoys the top status, and shears the same staff with government, while the power of parliament is lack of control. There is no income for the high governmental officials, and the excusive power is temporary. The judge works independently, and can make laws.Provincial Constitutional Movement in Guizhou promotes the modern legal and political theories, leads the modern reform, and transmits the modern legal and political thinking.
