Chapter 8 Commodity Inspection and Claim 8.1 Commodity Inspection General Introduction Import and Export Inspection in China Inspection Clauses Inspection Authority Inspection Certificate Inspection Bases and Inspection Methods Re-inspection General Introduction Definition Buyers Inspection Right Buyers Inspection Right According to Sale of Goods Act, 1893 (revised in 1979) The buyer who has not made inspection on the goods cannot be assumed to be acceptable to the goods, so he is not deprived of the right of refusing the goods until he is granted reasonable opportunity to inspect. Buyers Inspection Right According to United Nations Convention on Contracts for the International Sale of Goods The buyers shall implement the inspection or have others to do it in the shortest practical time. The inspection can be put off to the time when the goods arrive at the destination in case of the involvement of the transportation. Inspection Clauses in the Contract The inspection clauses in a sales contract are usually as follows: It is mutually agreed that the Inspection Certificate of quality and quantity weight issued by the China Import and Export Commodity Inspection Bureau at the port of shipment shall be part of the documents to be presented for negotiation under the relevant L/C.
