摘要我国行政复议立法以来，对适用调解机制的问题上一直存在争论，2007年《行政复议法实施条例》确立了调解的合法地位，但仍处于一个发展和完善的阶段。本文从对行政复议以及行政复议调解的基本伦理入手，对相关的涵义和概念进行探讨和引申；对行政复议中调解的特征进行归纳和总结；对行政复议中的调解适用进行法理分析，结合国外行政复议调解的适用规定和国内行政复议调解机制形成的历史经验，进一步阐述其产生和存在的现实性和必要性。并试从理论和实践两个方面探求其积极意义，立足县级政府在处理行政复议中的实际，通过一些具体案例以及基层复议机关的原始资料，对我国行政复议调解的现状和现实意义进行较为系统的论述。针对行政复议调解中存在的问题，进行认真的研究分析，找出问题存在的内在原因，并根据行政管理有关理论提出解决的对策。最后通过对行政复议调解的价值与制度预期等特点对该课题做出总结和展望。本论文共分五个部分：第一部分为绪论，主要对行政复议调解的研究目的和意义以及国内外对此课题的研究发展趋势进行了阐述，简单介绍了本文基本的研究方法和研究思路；第二部分为行政复议调解概述，论述了其涵义和特征，通过法理分析，阐述我国行政复议调解的形成过程，并以G县为例介绍了我国行政复议调解的现状；第三部分列举了我国行政复议调解中存在的几个主要问题；第四部分是揭示出行政复议调解中存在的问题的内在原因；第五部分是针对问题和原因提出对策；第六部分为结论。关键词：行政复议；调解；县级政府AbstractSinceourcountryadministrationhasreconsideredthelegislation,toissuitablethemediationmechanisminthequestionalwaystohavetheargument,in2007AdministrationReconsidersLawImplementationRuletoestablishthemediationlegalstatus,butstillisinadevelopmentandtheconsummationstage.Thisarticlefromreconsidersaswellastheadministrationtotheadministrationreconsidersthemediationbasicethicsobtaining,carriesontotherelatedimplicationandtheconceptdiscussesandexpands;Reconsidersthecharacteristictotheadministrationwhichmediatestocarryontheinductionandthesummary;Reconsiderstotheadministrationthemediationtocarryonthelegalprincipletheoryoflawanalysissuitably,theunionoverseasadministrationreconsidersthemediationtobesuitablethestipulationandthehomeadministrationreconsidersthehistoricalexperiencewhichthemediationmechanismforms,furtherelaborateditproduceswiththeexistencefeasibilityandthenecessity.Andtriesfromthetheoryandpracticestwoaspectstoseekitspositivesense,thefootholdcountylevelgovernment,intheprocessingadministrationreconsidersthereality,reconsidersinstitutionsfirsthandinformationthroughsomeconcretecasesaswellasthebasicunit,reconsidersthemediationtoourcountryadministrationthepresentsituationandthepracticalsignificancecarriesonamoresystematicelaboration.Reconsidersthequestionwhichinviewoftheadministrationinthemediationexists,carriesontheearnestresearchanalysis,discoversimmanentcaus
