Tosomeextent,itisalogicalassumptionandasubjective,prioriandaxiomaticcognition.PartII:Theinspectionofeconomicrights.Economicrightsastheinitialcategoryofeconomiclaw,whichisdemonstratedinthispaperascoreproposition.Theinspectiononeconomicrightsisdirectlyrelatedtothestatusoftheinitialcategoryofeconomiclawestablishedandconsolidated.Inthispaper,theauthorreferringto“economicrightsastheconceptofalotofcontroversy,aftercardingthetraditionaltheoryofrightsonthebasisoftheinteresttheory,putforwardtheconceptofeconomicrights.Then,theauthorgavethemeaningandtypesofeconomicrightsandconductedacomprehensiveinspectionontheeconomicrights.Economicrightswaslocatedinaspecificcategoryofeconomiclawandwasdividedintotherightsofeconomicfreedom,economicequality,economicdemocracyandtherighttosharethefruitsofeconomicdevelopment.Finally,fromthegenerationofeconomicrightsandtheinspectiononrelationshipsofitwithstatepower,economicpoweraswellassocio-economicpower,theessenceofeconomicrights“theoptimizationofwholeinterestsofsociety”berevealedcomprehensively,whichwillbeconnectedeconomicrightswiththeinitialcategoryofeconomiclawinherently.PartIII:Thetheoreticalbasisofeconomicrightsastheinitialcategoryofeconomiclaw.Anytheoreticalhypothesismustacquirecertaintheoreticalsupport.Economicrightsastheinitialcategoryofeconomiclaw,correspondstothebasicideasofeconomiclaw”humanism”intrinsically,embodiesthebasicvaluesofeconomiclaw“thebalanceofeconomiceffectivenessandeconomicequity”,andreflectsthenatureofeconomiclaw“theoptimizationofwholeinterestsofsociety”.PartIV:Therealisticbasisofeconomicrightsastheinitialcategoryofeconomiclaw.Economicrights,astheinitialcategoryofeconomiclaw,mustbegiventhepracticalsystemsupportandbeverifiedbythepracticalreasonofeconomiclaw.Inaccordancewiththeeconomicrelationshipadjustedbyeconomiclaw,theappealsofnewrightsthatderivedfromrelationshipsofnewinterestsisurgenttobeprotectedbynewlegaldepartments.Inconsiderationofthetraditionallegaldepartmentsisincapableofadjustmenttorelationshipsofnewinterestsandt
