AbstractThe measure of controlled delivery has been established in many countries, but in Chinese judicial practice, it could not been applied without any doubt, nor we could adopt those evidences through it. Since the criminal procedural law has been amended, not only controlled delivery gained legitimate status, but also the credibility of those evidences accepted by the controlled delivery become explicit, which means that it’s no longer need to adopt those evidences in the particular way of transformation, and we could just employ those evidences at the trial. However, the perfect evidence system of controlled delivery still lacks, and there are a lot of problems focusing on the collection, fixing and preservation of the evidences. So this paper plans to probe into the relevant problems about the evidence system of controlled delivery.This thesis is made up of introduction, conclusion and the main body, and the main body consists of three parts, nearly 30 thousand words.The first part summarizes the basic theory of the controlled delivery. It begins with the comparison with controlled delivery and inductive investigation. Both of the investigative measures could be easily mixed up no matter in the theoretical research and the judicial practice. Pointing out the difference of the two above helps to apply the controlled delivery measure better. Then this paper will elaborate the basic theory of controlled delivery in the aspects of credibility, proving ability and conducting code. Whether those evidences accepted by the controlled delivery possess credibility exists three kinds of theories, which are the theory of total repudiation, the theory of transformation and the theory of improvement of legislation. The theory of transformation prevails in our judicial practice, however, the author of this paper believes that the theory of improvement of legislation accords with the national conditions better.
