中文摘要劳动关系是人类社会最基本的社会关系,它是指劳动者和劳动力使用者双方在 劳动的过程中所结成的经济利益关系。对世界各国来讲,劳动关系的和谐、稳定是 促进社会经济发展的重要基础。建立和谐稳定的劳动关系, 对维护劳动者的合法权 益、保持社会稳定和促进经济发展具有重要现实意义。随着我国社会经济的发展, 私营企业在经济发展过程中的作用越来越重要,私营企业的劳动关系也在不断复杂 化,需引起政府以及企业各有关部门的重视。本文就此进行简要探讨,希望可以探 索出建立协调、和谐的企业劳动关系的现实途径,以期对构建和谐劳动关系、改善 民生有所裨益。本文以福建省为例,通过设计和发放调查问卷,对私营企业劳动关系进行深入 研究。得出私营企业劳动关系管理存在法制建设不完善、工会组织力量薄弱、三方 协商和集体合同流于形式、劳动监察力量薄弱,劳动执法问题日益突出、劳动争议 处理制度急需改进及社会与企业劳动关系管理相关人才严重不足等问题。剖析了问 题的成因主要是私有企业追求利润最大化的本性、劳动者一方缺乏主体独立性、劳 资双方权利不平等和在政府、私营企业之间缺乏独立的中间力量等。针对影响劳动 关系的因素及劳动关系的问题提出改善私营企业劳动关系管理的对策,即加强劳动 关系法制建设、有效发挥工会及其他组织在劳动关系管理中应有的作用、将三方协 商和集体合同制度落到实处、加强劳动监察执法力量、改进劳动争议处理制度和完 善社会保障制度等。关键词:私营企业;劳动关系;劳动关系管理Study on the Issue of Labor Relationship in Private Enterprises——base on the example of Fujian ProvinceAbstractLabor relation is a basic social relation of human society; it is the economic benefits between employer and employee in the process of labor forged relationship. Countries in the world in terms of the harmony and stability of labor relation is an important foundation for promoting social and economic development. To establish a harmonious and stable labor relation, has important practical significance to safeguarding the legitimate rights and interests of workers, and to maintain social stability and promote economic development. With the social and economic development of our country, the role of private enterprises in the economic development process more and more important, the labor relations of private enterprises has also been complicated; it should cause the attention of relevant departments of government and enterprise. This article briefly explore in this regard, we hope to explore a realistic way to establish the coordinating and harmonious labor relations in enterprises.
