AbstractAlongwiththemediadeveloped,moreandmorecriminalmisjudgedcasescameout.Inrecentyears,manynewCriminalwrongcaseshavebeenpublishedtothepublic.ThispromptedustothinkaboutthestatecompensationofcriminalwrongcasesofChina.Criminalwrongcasesaredifficulttodeterminedandcompensated.Partieshavetoappealdifficultlyforfairnessaftergettingaverdict.Manyfamiliesofinjusticeprotagonisthavebeingexhaustedtheirlifetimeandhardnesstopursuetheircase’sfairness.In1994,ChinapromulgatedtheNationalCompensationActandthestatecompensationsystemhasbeenestablishedfortwentyyears.Bynow,somanywrongcasesarestilldifficulttoberedressedandcompensated.TherearemanyproblemsontheStateCompensationSystemofourcountry.ThelegalsystemoftheStateCompensationisimperfect.Theideaoftheinstitutioniswrong.Wehaveineffectivesupervisionmechanismonthesystem.Thereasonsarethatwehavenonationalaidregimesysteminourcountry,Theconceptofstatecompensationandtheconceptofnationalaidregimehavenotbeendistinguished.TheotherreasonisthatPerformanceappraisalsystemresistanttheworthoftheStateCompensationSystemtocometrue.Therearestillmanyproblemsonaccountabilitymechanismsofcompensationmechanism.IntheeraofCivilizationprogressing,problematicwrongcasescompensationsystemcannolongermeetincreasinglegalrequestofthepublic.ItisnecessarytoreformandperfecttheStatecompensationofthewrongcasesinChina.IthinkthecriminaljusticesystemofcompensationofChinashouldbeperfectedasfollows:Firstly,perfectthelegislation,makeeffortstoimprovethestandardofcompensation,refinespiritualcompensationandstreamlineresponsibilityprincipleandsoon.Secondly,realizetheabolitionoftheperformanceappraisalsystem.Thirdly,establishanationalaidregimesystem.Fourthly,solvethestatecompensationandaccountablebundledproblems.Fifthly,setupanindependentauthoritytoimplementthenationalcompensationsystem.Sixthly,strengthentheimplementationofthesupervisionoftheStateCompensationSystem.IIKeyWords:criminalwrongcases;criminaljudicialcompensation;statecompensation;wrongcasesinvestigated;PerformanceappraisalIII目录
