However, the compensation should be limited to the value of the patent invention itself, and cannot be extended to the value of the standard incorporating such patent, other standards, or other characteristics outside the patent product. This article provides an overview of several classical U.S. cases that have examined the FRAND commitments, with particular emphasis on how those courts have approached the issue of determining a FRAND royalty rate. Several key guidelines have be summarized from these cases, which is very helpful in aiding judges, litigators, and negotiators in assessing FRAND royalties in the future. These guidelines include but not limited to the following: hold-up and royalty stacking, requiring changes to the traditional reasonable royalty analysis, quantitative formula for determining FRAND rates based on proportionality principles, apportionment, and royalty base and the entire market value rule.
