ResearchonIssuesoftheJustifiableDefenseAbstractJustifiabledefenseisalegalcircumstanceofcriminallaw,andtherearealotofcasesinthejudicialpractice.Thedefiniteprovisionsofthecriminallaw,however,didnotrepresentthattheeffectofthejudicialpracticeisgood.Injudicialcircles,therearedifferentunderstandingsabouttheboundaryofthejustifiabledefenseandthecontentofviolation,whichmakethejustifiabledefensesystemdifficulttocarryout，andevensomenon-statutoryplotssuchasthevictimfaultaremoreeasiertoimplement.Startingfromacase,theauthorintroducesthedisputefocusontheuseofself-defensesysteminjudicialpractice;combinedwiththelegislativepurposeandtheconstitutiverequirementsofthesystem，theauthordoessometheoreticalanalysisanddemonstrationaboutthesystem,anddiscusssomeproblemabouthowtoidentifytheboundaryofthedefense,violationsandotherissuesconcerned,hopingtofindsomewaytoresolvethepracticalproblems.Thefirstpart:theauthoranalyzesacasethatfrequentlyappearsinjudicialpractice,liststhecontroversyonthecase,aswellasthejudicialjudgementofthecase,whichembodiesthecriminaljusticepracticeinChinaandalsofindsomematerialforthefollowinganalysis.Thesecondpart:theauthorintroducesandanalysesthelegislationsonthelimitsofself-defenseinallcountries,andpointsoutthesignificanceofthelegislationinChina.Thethirdpart:theauthorexploresthejudicialdeterminationofthenecessarylimitsofjustifiabledefenseinChinascriminallaw,elaboratestheconcept,thenatureofthelimitofthedefense,comparativelyanalyzesvariousacademicviewsofthetheoreticalcirclesonthelimitofthedefense,putforwardthebasisforconsiderationofthenecessarylimits,thendiscussesthenatureoftheunjustifiabledefenseandtheissuesofthespecialdefenserightonthebasisabove.Thefourthpart:theauthorinvestigatesthedifficultiesofcriminalviolation,elaboratestheconcept,thefeaturesofthecriminalviolation,emphasizesthatinordertorecognizethejustifiabledefense,weneedtoclearthecontentandsubstanceoftheviolationfirstto.Andthentheauthoranalyzessometheoreticalcontroversialissuesfromtheperspectivesoforigins,natureand
